- 1.3 Effective Date: These terms are effective as of January 15, 2024. This version supersedes all prior agreements.
- 1.4 Modifications: Ember & Stone Provisions reserves the right to modify these terms at any time. Significant changes will be communicated via prominent notice on our website or email. Continued use after changes constitutes acceptance.
- 1.5 Governing Law: This agreement is governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any legal action shall be commenced in the courts located in Markham, Ontario.
Orders, Payment & Delivery
Our commitment is to provide you with premium grilling essentials seamlessly. This section outlines the process for ordering, payment, and receiving your Ember & Stone Provisions products.
2. Product Ordering and Fulfillment
- 2.1 Ordering: Placing an order confirms your intent to purchase the selected items. An order confirmation email will be sent at the time of purchase.
- 2.2 Payment: We accept major credit cards and other secure payment methods as indicated at checkout. All prices are in Canadian Dollars (CAD) unless otherwise stated. Payment must be received in full before order processing.
- 2.3 Delivery: Shipping costs and estimated delivery times are calculated at checkout based on your location. Customer is responsible for providing accurate shipping information. Ember & Stone Provisions is not liable for delays caused by third-party carriers or incorrect address details.
- 2.4 Availability & Pricing: Product availability is subject to change without notice. While we strive for accuracy, pricing errors may occur; we reserve the right to correct such errors and cancel orders if necessary.
- 2.5 Cancellations & Modifications: Orders may be cancelled within 24 hours of placement if not yet processed for shipment. Modifications are handled on a case-by-case basis through customer service.

3. Quality Assurance and Indemnification
- 3.1 Product Warranty: We warrant that our products are free from defects in material and craftsmanship at the time of delivery. Any issues must be reported within 7 days of receipt. Our liability is limited to replacement or refund of the defective product.
- 3.2 Limitation of Liability: To the fullest extent permitted by law, Ember & Stone Provisions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
- 3.3 Disclaimer of Warranties: Except as expressly provided herein, all products are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose.
- 3.4 Indemnification: You agree to indemnify, defend, and hold harmless Ember & Stone Provisions, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising directly or indirectly from your breach of these terms.
- 3.5 Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, embargoes, riots, strikes, or natural disasters.
